[nativetemplate!1} %] sections desert dispatch lv leader review hesperia star obits e-edition crime map autos jobs homes classifieds subscribe site archive subscribe now in filing, rancho motor co. in victorville accused of credit, bank fraud shea johnson staff writer @dp_shea monday feb 20, 2017 at 6:11 pm feb 21, 2017 at 4:29 pm "they knew he had these documents," attorney tristan g. pelayes alleged, "that would show that even the owners were committing fraud." victorville — rancho motor company routinely inflated incomes on loan applications enabling customers to qualify for vehicles they otherwise could not afford, a former finance employee claims in a lawsuit. ownership and management were informed of these alleged fraudulent practices and failed to take action, christopher white, a finance and insurance associate at rancho from april 2015 until his resignation in december, charged in a cross-complaint filed feb. 14. rancho denied these serious accusations, and others, in a statement monday to the daily press, calling white "a former disgruntled employee." the dealership, located in victorville, sued white last month for allegedly stashing documents with customers' sensitive data onto a personal email account. in june, rancho said it learned "some employees may be copying and taking photographs of private, financial customer information on their phones," the dealership's complaint said. rancho believed that white had "obtained and retained unauthorized copies of customer information of numerous customers," according to the suit, which the dealership said was filed to protect customer privacy. in its statement monday, rancho claimed that white "exposed some of (the dealership's) customers to identity theft by sending their completed credit applications in unsecured emails to his home computer." it's a determination it made following an investigation. in probing the scope and extent of the data breach, the dealership had retained an outside vendor to conduct a forensic investigation of white's former work computer and email, court records show. "the dealership successfully obtained an emergency order requiring mr. white to return its customers' documents," rancho said in its statement, adding that it had previously notified affected customers. but tristan g. pelayes, an attorney representing white in the cross-complaint, said monday that his client was, in fact, a whistle-blower who was retaliated against for exposing widespread credit and bank fraud at the dealership by managers and staff, which had been spurred by, and cultivated under, a high-pressure sales environment. pelayes told the daily press that the dealership purportedly had set up meetings with customers, notified them about the identity theft risks and offered a free year of credit monitoring. but as part of those meetings, according to pelayes, customers were also asked to sign a declaration that they, themselves, reported their incomes on loan applications. pelayes said this was significant because rancho employees regularly submitted drafts of loan applications to the company's owners so that the customers' incomes could be adjusted to the ideal position for loan approval. "sometimes the customers went along with it and sometimes the customers did not know their income was being changed," he said by phone. "the only application that ended up with the bank was the final one." the superfluous documents otherwise would be destroyed, pelayes said. "they knew he had these documents," he said, "that would show that even the owners were committing fraud." rancho has denied all wrong-doing and accused white of being "desperate to create chaos in the courts." "we will prove to a court that mr. white's allegations are demonstrably false," it said. other accusations, as detailed in last week's cross-complaint, include discrimination against race, gender and sexual orientation, and withholding lower interest rate offers to collect more money from customers. white claimed his protests about these alleged activities were ignored or dismissed. he said customers were systematically racially profiled and that customers and employees were described in wildly pejorative terms. african americans were said to have "nappy credit," middle eastern employees were referred to as "ali babas" or worse, and customers with poor credit were called "roaches" or said to be unable to "finance steam off a hot dog." white resigned in december, saying the blowback from ownership and management for whistle-blowing had grown intolerable. but rancho maintained monday that white's "actions were in violations of state and federal law."
